1. Agreement to Terms

By accessing and using CheckpointAce ("the Platform", "our Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and CheckpointAce. If you are under 18 years old, your parent or legal guardian must agree to these Terms on your behalf.

2. Description of Service

CheckpointAce is an AI-powered educational platform designed to help IGCSE Checkpoint students practice, learn, and prepare for their examinations. Our Service includes:

• AI-powered practice questions for Math, English, and Science
• Instant feedback and answer explanations
• Progress tracking and performance analytics
• Personalized learning recommendations
• Mock Cambridge tests and assessments
• Parent/guardian dashboard for monitoring student progress

3. Account Registration

To use CheckpointAce, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Subscription and Payment

Free Trial: We offer a 14-day free trial for new users. You will not be charged during the trial period, but you must provide payment information to start the trial.

Paid Subscriptions: After the trial period, your subscription will automatically renew according to your selected plan (Basic, Premium, or Family) unless you cancel before the renewal date.

• Subscription fees are charged monthly in Malaysian Ringgit (RM)
• Prices are subject to change with 30 days' notice
• Payment is due at the beginning of each billing cycle
• We accept major credit cards and other payment methods as indicated
• All fees are non-refundable except as required by law

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

5. User Conduct

You agree NOT to use the Service to:

• Share your account credentials with others
• Copy, distribute, or modify any content from the Platform without permission
• Use automated systems (bots, scrapers) to access the Service
• Attempt to reverse engineer or extract source code from the Platform
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Circumvent any access restrictions or security measures
• Use the Service for commercial purposes without authorization

Violation of these rules may result in immediate account termination.

6. Intellectual Property Rights

All content on CheckpointAce, including but not limited to text, questions, graphics, logos, images, software, and AI algorithms, is owned by CheckpointAce or our licensors and is protected by copyright, trademark, and other intellectual property laws.

License Grant: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes only.

Restrictions: You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from our Service without our written permission.

7. User-Generated Content

You may submit questions, feedback, or other content ("User Content") to CheckpointAce. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving our Service.

You represent and warrant that your User Content does not violate any third-party rights and complies with these Terms.

8. Privacy and Data Protection

Your use of CheckpointAce is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

We are committed to protecting student privacy and comply with applicable data protection laws including the Personal Data Protection Act (PDPA) in Malaysia.

9. AI-Generated Content Disclaimer

Our Platform uses artificial intelligence to generate practice questions, provide feedback, and make recommendations. While we strive for accuracy:

• AI-generated content may occasionally contain errors or inaccuracies
• Our Service is a learning aid and should not replace formal education
• We do not guarantee specific exam results or academic performance
• Students should verify important information with teachers or official resources

10. Service Availability

We strive to provide reliable, uninterrupted access to CheckpointAce. However:

• We do not guarantee the Service will be available 24/7 without interruption
• We may perform maintenance, updates, or modifications at any time
• We reserve the right to modify or discontinue features with notice
• We are not liable for any downtime, delays, or service interruptions

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CheckpointAce is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not warrant that the Service will be error-free or uninterrupted
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid in the 12 months before the claim
• We are not responsible for third-party content, links, or services

12. Indemnification

You agree to indemnify and hold CheckpointAce, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
